Purpose

The Privacy Notice aims to give individuals applying for employment with Investec Limited (“Investec”) information on how their personal information (i.e. information that directly or indirectly identifies an individual) is processed. Candidates for the purposes of this Privacy Notice include individuals applying for employed status with Investec, individuals applying for Investec graduate programme opportunities, fixed-term contractors and consultants (notwithstanding the fact that short-term contractors and consultants do not have employed status) of Investec (“Candidates”).

Processing of personal information
  • Investec will process personal information including Candidate personal information in accordance with applicable privacy and data protection laws and regulations.
  • The provision of personal information by Candidates is necessary in order for Investec to fulfil its legal and contractual obligations and where it is in the legitimate interests of Investec to manage the recruitment process.
Types of personal information

Investec processes the following types of personal information for the purposes set out in this Privacy Notice:

  • Identification information (e.g. name, surname title and identification / passport number);
  • Jurisdiction information (e.g. place of birth, country of residence, country of citizenship)
  • Contact information (e.g. mobile number, email and postal address);
  • Date of birth;
  • Education history;
  • Current employment status and employment history including salary details;
  • Right to work information (including passport and visa details);
  • Background screening information (including criminal record checks, employment and reference verification, credit and payment profile checks and other screening checks as permitted by law);
  • Other information voluntarily disclosed by Candidates (including special personal data).

Special personal information (including, for example, religious or philosophical beliefs, race or ethnic origin, trade union membership, political persuasion, health or sex life or biometric information or personal information related to criminal behaviour) are processed solely in accordance with applicable data protection laws and regulations and where the processing is necessary for Investec to comply with employment law, with the consent of the Candidate or where such processing is specifically authorised or required by law.

A Candidate may withdraw consent referred to above provided that the lawfulness of processing of personal information before the withdrawal or processing of personal information in accordance with data protection legislation is not affected.

Purposes of processing personal information

Investec processes personal information for the following purposes:

  • Assessing applications for employment, graduate programme opportunities, contractor and consultancy positions;
  • Verifying information provided by Candidates including qualifications, professional memberships, employment history, references, identity and right to work status;
  • Conducting background screening checks including credit, criminal, fraud prevention and other screening checks where appropriate and permitted by law;
  • Assessing a Candidate's suitability for the role applied for and making recruitment and hiring decisions;
  • Communicating with Candidates during the recruitment process;
  • Complying with legal and regulatory obligations applicable to Investec;
  • Maintaining records relating to recruitment activities; and
  • Monitoring, reporting on and evaluating the effectiveness, diversity and fairness of Investec's recruitment processes.
Disclosure of personal information

Personal information may be disclosed to the extent necessary for the above purposes to the following recipients, subject to applicable data protection laws and regulations:

  • Other entities in the Investec group;
  • Other service providers involved in the provision of services to Investec as part of its recruitment process;
  • Law enforcement, government and tax collection agencies and any governmental or administrative body in order to comply with applicable laws, court orders, or government regulations;
  • A third party that is looking to acquire or does acquire all or part of the assets or stock of Investec, or that succeeds Investec in carrying on all or a part of the business of Investec
    whether by merger, acquisition, re-organisation or otherwise;
  • Authorised verification agents who may access personal information in order to conduct background screening checks including but not limited to it to credit, employment references, criminal record, fraud prevention, identity verification (ID), drivers’ license and professional qualifications.
Securing personal information
  • Investec may hold personal information electronically and/or in hard copy form. Access is restricted to authorised Investec employees only in order to allow them to perform their duties of employment.
  • Investec will implement appropriate technical and organisational measures to protect personal information against loss or theft, as well as from accidental or unlawful destruction or alteration, unauthorised access or disclosure and against all other unlawful forms of processing, regardless of the format in which it is held. 
Rights of candidates regarding the processing of personal information

Where permitted by law, Investec may retain Candidate information after the completion of a recruitment process in order to consider the Candidate for future employment opportunities, unless the Candidate objects to such processing or requests deletion of the information where applicable.

Candidates have the right to:

  • Request confirmation of whether Investec holds personal information about them and request access to their personal information.
  • Request where necessary, the correction, destruction or deletion of their personal information.
  • Object on reasonable grounds, to the processing of their personal information in line with data protection legislation.
  • Object to the processing of their personal information for direct marketing, other than direct marketing through unsolicited electronic communication, at the time their information was collected and at each time they receive a communication for direct marketing communication that has not been refused by them. Once an objection is processed and all requirements have been met, Investec will no longer process the personal information. 
Enquiries, requests or concerns

Please note that the above requests should be made to the Human Resources Department.  The above requests will only be fulfilled if the requirements of relevant applicable data protection laws and regulations have been met. It is every Candidate’s responsibility to provide Investec with accurate personal data and to inform Investec of any changes to their personal information. All enquiries, requests or concerns regarding this Privacy Notice or relating to the processing of personal information including requests referred to above, should be sent to hr@investec.co.za.
